Gabriel Money – Electronic Communications Consent (E-SIGN)

By consenting, you agree to receive all required disclosures, agreements, and notices electronically instead of paper. You may withdraw consent at any time, though some or all services may no longer be available.

Introduction

This Electronic Communications Disclosure ('E-SIGN Consent') applies to all communications for services provided by Gabriel Money, Inc. ('Gabriel Money', 'we', 'us'). The E-SIGN Act allows us to provide communications electronically and to conduct transactions with you electronically, with your consent. This Consent describes how we deliver and receive communications to and from you electronically and asks you to consent to use electronic records and signatures in our relationship with you. If you do not agree to this Consent or you later withdraw your consent provided herein, you may not be able to continue to use our services. If you do not agree, or if you later withdraw consent, you may not be able to continue to use our services.

Definitions

“We”, “us”, and “our” mean Gabriel Money, its affiliates, agents, and service providers.
“You” and “your” mean each applicant, account owner, and anyone else with access to the account. If there is more than one owner, then these words mean each account owner separately, and all account owners jointly.
“Communications” include applications, agreements, disclosures, notices, fee schedules, statements, response to claims, privacy policies, record, document and all other information related to your account or use of Gabriel Money products and services. “Products” means all accounts, products, or services we offer now or in the future.

The words “include” and “including,” when used at the beginning of a list of one or more items, indicates that the list contains examples and is not exclusive or exhaustive, and the items in the list are only illustrations.

Scope of Consent

This Consent applies to all Communications and Products. By using our services, you agree to receive Communications electronically, to the extent allowed by law. This includes, but is not limited to:
- All Legal and regulatory disclosures and communications associated with the Product;
- The account agreement, including any amendments thereto, and any and all agreements by and between you and us that relate to a Product;
- Privacy policies and notices
- Statements and responses to claims
- Subscription billing disclosures and recurring payment authorizations
- Credit bureau access and reporting disclosures (via Array)
- Bank account linking disclosures (via Plaid). Gabriel Money does not store banking credentials
- Student Loan Aid service agreements

- Consent to marketing messages
- Prize program terms and notifications

- All other communications between us and you concerning the Product and any related transactions, products or services.

- SMS for Two-Factor authentication (2FA) and customer care communications regarding support, account management and other avenues of customer interaction

This consent includes subscription billing disclosures, recurring payment authorizations, and communications related to financial data accessed through our partners, including Plaid (bank linking) and Array (credit bureau services

Sometimes the law, or our agreement with you, requires you to give us written notice. You must still provide these notices to us on paper, unless we specifically tell you in another Communication how you may deliver that notice to us electronically.

We reserve the right, at our sole discretion, to discontinue the provision of electronic Communications, or to terminate or change the terms and conditions upon which electronic Communications are provided. We will provide you with notice of any such termination or change as required by law.

Methods of Delivery

We may deliver Communications electronically through:
- Email
- Our website or a designated secure portal
- Our mobile application
- Text message or push notification
These satisfy any legal requirement that Communications be in writing.

System Requirements

To access and retain electronic Communications, you must have:
- A current web browser (Chrome, Safari, Firefox, or Edge)
- A device running iOS 14+ or Android 10+ (or a computer with internet access)
- An active email account
- The ability to download, save, or print documents
We may update these requirements as necessary to ensure ongoing access. We will notify you if changes are substantial.

Keeping Your Information Current

You are responsible for providing and maintaining a valid email address and contact information. Communications sent to your last known email address will be deemed received. You can update information (such as your e-mail address) by contacting us at support@gabriel.money . We are not responsible for any delay or failure in the receipt of the Communications if we send the Communications to the last e-mail address you provided to us.

Requesting Paper Copies

We will not send paper copies of any Communication; however, we reserve the right, but assume no obligation, to provide a paper (instead of electronic) copy of any Communication that you have authorized us to provide electronically. You can obtain a paper copy of an electronic Communication by printing it or by requesting that we mail a paper copy. To request a paper copy, email us at support@gabriel.money during normal business hours, except for national holidays. There may be a fee associated with the request for the delivery of paper copies of any Communication provided electronically pursuant to this Consent.

Withdrawal of Consent

You may withdraw your consent at any time by contacting support@gabriel.money. Withdrawal may result in termination of your subscription and discontinuation of services. Refunds or returns of funds will follow our Terms of Service. Prior Communications provided electronically remain valid.

Consent

By applying for or using a Product, or by selecting a call to action (such as 'I Agree'), you consent to the use of electronic records and signatures. By providing consent, you confirm you can access electronic Communications, have the required technology, and are authorized to consent on behalf of all account holders.

If you seek to obtain a new product, service or account with us, we may remind you that you have already consented to receiving electronic Communications and using electronic signatures in your relationship with us. 

Continuing to use our Products after receiving updates to our system requirements signifies your acceptance of the change and reaffirmation of your consent.
